Terms of Service

1. Services provided

Clean Break Divorce LLC, doing business as Clean Break Divorce ("Clean Break," "we," "us"), is a non-attorney document preparation service. We prepare, organize, and file legal documents for uncontested divorces in Kings County (Brooklyn) and Richmond County (Staten Island), New York.

Our services include, but are not limited to:

• Preparation of all required New York State uncontested divorce forms
• Filing documents with the Kings or Richmond County Supreme Court
• Coordination of document execution and notarization
• Pickup of signed Judgments of Divorce from the courthouse
• Retrieval of certified copies of divorce judgments
• Filing of Notice of Entry
• À la carte document preparation and filing services as described on our website

Services are limited to those expressly described in the package or à la carte selection you purchase. We do not provide services beyond the scope of your selected package without separate agreement and payment.

2. Not legal advice

We do not provide legal advice, legal opinions, legal strategy, or legal representation of any kind. We do not represent you in court or before any judicial or administrative body. Communications with Clean Break Divorce are not protected by attorney-client privilege.

Nothing on our website, in our forms, or in any communication from us constitutes legal advice. Use of our services does not create an attorney-client relationship.

If you need legal advice — including advice about whether your divorce qualifies as uncontested, how to handle disagreements with your spouse, or how to protect your legal rights — you should consult a licensed New York attorney before proceeding.

3. Eligibility

Our services are available only for uncontested divorces where:

• At least one spouse resides in Kings County or Richmond County, New York
• At least one spouse has resided in New York State for a minimum of one continuous year
• Both spouses agree to the divorce and all related terms
• The marriage has been irretrievably broken for at least six months
• There are no unresolved disputes regarding property, debt, support, or custody
• There is no active order of protection between the parties

We reserve the right to decline or discontinue services at any time if we determine that a case does not meet our eligibility criteria or falls outside the scope of uncontested divorce services.

4. Fees and payment

Fees for each service tier are listed on our website and are due in full before work begins. All fees are flat-rate and include only the services described for the selected package.

The following are not included in any package fee and are billed separately at cost:

• Court filing fees (currently approximately $335 for New York uncontested divorces)
• Notary fees charged by third-party notaries
• Any additional government fees assessed by the court

Payment is processed securely through Stripe. By providing payment information, you authorize Clean Break Divorce to charge the full package or service fee at the time of purchase.

5. Refund policy

We want every client to feel confident engaging our services. Our refund policy is as follows:

• Before work begins: Full refund if you cancel before we have begun document preparation.
• After work begins: Partial refund based on work completed. We will provide a written breakdown of work performed and the corresponding fee retained.
• If the case becomes contested: We will immediately pause work and refund all fees attributable to work not yet performed. We cannot refund fees for work already completed.
• After filing: No refund once documents have been filed with the court, as court filing fees are non-refundable and significant work has been completed.
• Court rejection due to client error: If documents are rejected because of inaccurate information provided by the client, correction fees may apply.

All refund requests must be submitted to [email protected]. Refunds are processed within 5–7 business days.

6. Client responsibilities

By engaging our services, you agree to:

• Provide accurate, complete, and truthful information on all intake forms and in all communications
• Notify us immediately if any information changes or if your divorce becomes contested
• Review all prepared documents carefully before signing
• Sign documents in the presence of a notary where required
• Respond to our email communications within a reasonable time (we consider 5 business days reasonable)
• Understand that delays caused by your non-response are not our responsibility

You acknowledge that providing false information on court documents is a serious matter and that Clean Break Divorce bears no responsibility for errors resulting from inaccurate information you provide.

7. Limitation of liability

To the maximum extent permitted by law, Clean Break Divorce LLC's liability to you for any cause whatsoever shall be limited to the amount you paid us for the specific service that is the subject of the claim.

We are not liable for:

• Court delays, rejections, or procedural changes outside our control
• Errors resulting from inaccurate information you provided
• Outcomes of your divorce proceedings
• Any consequential, indirect, or incidental damages
• Actions or inactions of third parties including courts, notaries, or process servers

8. Termination of services

We reserve the right to terminate services and issue a prorated refund at our discretion, including if:

• Your case becomes contested
• You provide false or misleading information
• You become unresponsive for more than 30 days
• We determine the case falls outside our service scope

9. Disputes

These Terms are governed by the laws of the State of New York. Any dispute arising from your use of our services shall first be addressed through good-faith communication with us at [email protected]. If unresolved, disputes shall be submitted to binding arbitration in Kings County, New York, under the rules of the American Arbitration Association.

10. Changes to these terms

We may update these Terms from time to time. We will post the updated version on our website with a revised date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
